No such thing as effective control 🤷🏼‍♂️ Well, not for a TM, but there is for a director. the TM must have the power to overrule the Director. Effective control is what it says not an advice line....

Ask tomorrow at the OTC. The period of grace is a vet fixed timeline with a start and finish date. You can’t operate beyond PoG without the OTC approval.

Unless it really is the odd day, expect to go on a zero hour contract, it keeps the operator out of the TC and satisfies tax etc.
can’t go as a driver under your own Ltd Co.

A TMs role is not to ensure smooth operation, surely that an Ops Managers role.
If the TM puts veh VOR or stops driver exceeding hours etc, that’s not helping operations.

Got to ask, what’s the actual or perceived benefit. Remember take a veh off means surrendering THAT disc, put veh back on means getting a new disc. Why do it?

A recently publish PI clarifies Ltd Driver would be classed as using the veh, as such the Ltd Co is using veh without O licence.
Beware the operator could end up being at PI for fronting

There are loads of websites who’ll calculate what you’ll pay in tax and Nat Ins. If you’re already into 40% tax, it ou already know every pound uou earn will have 40p tax and the Nat Ins drops from 10% to 2%. At about that same income

It’s correct an O licence is not transferable. However, the OP is looking to be the new director of a company that happens to hold an O I licence.
They just need to notify change of details to the OTC, as long as they have good repute etc, there’s no reason they can’t do it.

Did you have an HGV when disqualified or are you planning to get it?
You’d do well to check that as some of the drug offences remain on licence for 10+ yrs.

What’s it taxed as? If it’s goods then yes for tacho, if it’s private, then no tacho required- full declaration at test. And of course, carry goods entirely at your peril

Auditing a subcontractor has quite different needs to an O licence one. It could easily miss the bits that are important for the contract.

Besides the financial reasons, the operator has no control over the Ltd driver. Insurance can be an issue, any infringements could be referred tab to he Ltd Co rather than to the driver. Can I come back to the OP, we assume we’re talking about WTD. Just be mindful, we’re also
Overlaying EU rules and perhaps the TM and the OP are not arguing over the same thing. Just a thought that the we may be ignoring one for WTD but it’s included in EU.

Pretty much all operators know using a Ltd driver is a no-no as far as the TC is concerned. Whilst few may still be going it, that gives you an idea of how they are likely to deal with other things as well

Investigate, find out why and pass to the director to make a decision. Depending on the outcome, final written warning The TC has nothing to do with the discipline process.

Speak to the TM, they should download before you leave. Your new employer don’t be interested in what you’ve done before other than check the 28 days and how you drop into their weekly test system. It’s your overtime / money - go and make them do something. They’re obliged to download 28 days snyway...

First thought is if they only have a rigid then unlikely they have authorisation for trailers in the O licence.
By the time you’ve converted for a drawbar, it would prob be easier, quicker and cheaper to buy one
