The rhetorical question for the operator /TM , is why or how did you have continuous and effective management of the driver that meant they could not return to base at the end of the week?
Or, when do you plan applying for a second OC near the drivers address so you can legit park nearby?

They just need to notify change of details to the OTC, as long as they have good repute etc, there’s no reason they can’t do it.

As others say, DVLA points are unique to the UK licence.

Did you have an HGV when disqualified or are you planning to get it?
You’d do well to check that as some of the drug offences remain on licence for 10+ yrs.

It’s not written anywhere, it’s a broad sweep statement that would apply to the majority of operators - that’s the majority not all operators

That does apply but it’s condition...

What’s it taxed as? If it’s goods then yes for tacho, if it’s private, then no tacho required- full declaration at test. And of course, carry goods entirely at your peril

@AndryUrman, as an ETM, if the operator isn’t feeding the instructions to download and forward the data, how can it not be the right thing for the ETM to go and get it done, even if it’s sitting at the gate for 6hrs, meeting out on the road or a midnight raid. Or come if the TM1. What’s your alterna...

Auditing a subcontractor has quite different needs to an O licence one. It could easily miss the bits that are important for the contract.

Besides the financial reasons, the operator has no control over the Ltd driver. Insurance can be an issue, any infringements could be referred tab to he Ltd Co rather than to the driver. How many times have we had drivers say ‘not my problem, speak to my company’ then give the bird. Why can’t folks ...

Re: Any advice please. Just starting out as a Ltd Class1 driver, wondering what the position is without own tractor and
Pretty much all operators know using a Ltd driver is a no-no as far as the TC is concerned. Whilst few may still be going it, that gives you an idea of how they are likely to deal with other things as well

Investigate, find out why and pass to the director to make a decision. Depending on the outcome, final written warning The TC has nothing to do with the discipline process.

Investigate it properly, interview the driver, follow the discipline procedure and put it to the directors to make a decision. Anything else could lead to a tribunal and a load of grief. Ps. Don’t share the video with anyone in the office or on social media. I’m guessing this is an old post but dm i...

There’s a saying ….. never die in the right. Whilst the Porsche should have given way, the OP could have done something to avoid or help reduce the incident, namely to open the gap. From an insurers perspective, the operator will prob share some of the repair costs across both vehicles. From the ope...

Your best option is to find an external TM whom wants just a bit of extra work. Should be around £300 per month. but was advised that it wasn’t necessary until 2026? Here pal Yes tacho will be needed in 2026, but not today for those under 3.5t and those over 3.5t the rules haven’t changed - tacho a...

Speak to the TM, they should download before you leave. Your new employer don’t be interested in what you’ve done before other than check the 28 days and how you drop into their weekly test system. It’s your overtime / money - go and make them do something. They’re obliged to download 28 days snyway...

First thought is if they only have a rigid then unlikely they have authorisation for trailers in the O licence.
