It’s almost an eternal circle. There are two certainties though - legally, if you want to drive you have to do it and secondly, there’s no legislation to say employers have to pay, if they do it’s a perk. I’m amazed HMRC don’t charge drivers for benefits in kind 😂

This journey type is only out of scope under exemption, if the driver has never (ever) carried goods or passengers in the course of their employment with that operator, otherwise (or, after the first time they do carry goods or passengers) it is in scope of 561/2006 (as amended).

Ask the TM, it’s a statutory requirement to notify if they were an employee at the time. Regardless of it happening at work or not.
What investigation was done etc. just coz they left or DVLA (not DVSA) knows it doesn’t avoid the obligation by the operator 😀

- Make sure trucks are downloaded
- drivers cards downloaded
- input the reason for any missing mileage (though there shouldn’t ever be any)
- make sure trucks/trailers make their PMI’s
- get infringements signed off?

As most have said, as long as your’e in the yard then no problem- no need for any licence. The company should review it with their insurers and that’s it.
No need for your tacho card as it’s totally outside of the regs.
Presumably the depot TM would have said that and been part of the discussion ...

Likely to be concerns over the new operator as much as being a recently qualified TM
I can’t see why a new tM /owner operator is fine, but a new ETM isn’t. There are more than a few seasoned internal/ETMs going before the PI so experience isn’t a defacto of being competent.

As a guide, a DVSA test station would not permit a laden refuse vehicle in their premises as it is a serious health hazard. I am sure your own premises H&S risk assessment would have similar controls. Suggest a discussion with your H&S Competent Person might be in order.

Laden means at least 65% GVW and axle weights.
As of April 25 only laden RBTs will be accepted.

Perhaps smaller operators, and no idea what small operator means, but perhaps the effect of TC sanctions are more impact than on the larger ones.
From a compliance perspective, smaller operators are closer together so the whole compliance could or should be much easier to maintain

Get your feet under the table, set a planned timetable. ER format would be the way I’d go. It’s what the OTC refer to Then prioritise with timescales.
Worry less about where they are now, revisit it in 3 months then worry at the shortfalls and enjoy the improvements
