Re: Hi evening all, For those who still employ Ltd drivers, be aware!

So how will the affect agency drivers? Eg company A uses drivers from Agency A Will that still be acceptable? yes you can still use agency drivers buy only to fill a short term requirement. Ie you cannot just have someone with an agency for a year. There was a case where a company was doing this an...

Bit more to it than that if you read the article - Couldn't meet financial standing which is an automatic revocation anyway and the TM had a Polish CPC which wasn't valid agree this is just a small part of it but a part none the less. there has been 2 other cases this year which involve Ltd drivers...

let's agree to disagree. The truth is all ltd and self employed work the same and the same way you can be ltd or self employed plumber, engineer, electrician and etc you can be a driver. Some people just don't like it. Some drivers prefer to be employed for paid holiday sickness, stability etc and ...

can you please detail what the unfair advantage is? And why is that not applicable to let's say External TM? the unfair advantage is that the business will have less operating costs as they do not need to pay tax or NI for the drivers saving them around 15% on wages. plus if you look at ir35 you wi...

it really makes no sense. You have a choice, you're an ltd driver, meaning you can work for whoever you want at any point without being tied in by a contract and a notice period. You have a choice of everything, being an ltd driver means that you choose, the haulage company cannot make a schedule a...

You apply by contacting enquiries@otc.gov.uk and detail the reasons why, ie you have imenent work. they will respond asking fir the fee to be paid and so long as the financial standing and everything else is OK, then it will be issued. Jeezo guys WTD is not that hard.
you can work no more than 6 hours without a break. at that point a minimum of 15m must be taken
if you whole shift is more then 6h but less than 9 then a total of 30 min break is needed. if your whole shift is more than 9 hours then 45 min of break is needed

Also this has been conducted on a loaded trailer as it would state "insufficient load on axle" if it was not loaded. I would however be concerned with axle 3 as it is showing a 34% imbalance which in the eyes of the TC is considered a fail and would need rectified, even though it stated p...

so this is how it works with an interrupted rest you need 11hrs of in total, so the 3h as the beginning plus the 1.5 hrs on the boat means 6.5hrs after the boat. you get off at 13:45 then need 30m to disembark which takes it to 14:15. then your 6.5hrs commences taking you to 20:45 before you can st...

under EU drivers hours legislation they will have a max day of 30 and will require a minimum of 9 hours daily rest, as this is the end of the day all travelling time will count as worked time and therefore count towards the 30 hour day 21 hour duty limit)

so many negative comments! would real world experience be an advantage? yes. is it necessary? No. The reality is being a TM is about following legislation. it's all about knowledge. There is no real world interpretation of legislation.

ok, so if he contacts the TC they could give him a concession of 6 months without a transport manager as long as he explained the situation. following this he will either need to add a TM or surrender the license. Best to speak to his caseworker and work it out directly
