Hi evening,
I'm looking for help or advice.
Does anybody know good Road Haulage/ Transport Law Solicitors?

Story:
I had flat bed trailer. Person from company where I had collection called me and chasing me that I'm late for collection. When I arrived as planned by the office he wasn't there arrived shortly after me as he went to another job. Quickly jumped in Fork lift truck lift Load (Doubel Factory/Production line) on my trailer, quickly parked and left.
I did inspect load walk around multiple times. To me it looks like One big piece. I used 3 straps through middle 3 straps over the top and 1 strap on each end to secure movement load max weight 4 tons.
After 20 miles of driving middle of load collapsed and slides of the trailer.
No one get hurt no damage on the road no traffic blocked as straight away another drivers helps to pull it of the road to the gras.

Police arrived took pictures and statement, recovery arrived they did manage to put load back on and we all left.

Now I get letter to pay £100 and 3 points.
I do not agree.
Is it worth it to appeal???

I know as driver I'm responsible for load, but I think I did all what I could to secure load.

We agree with Avardotra. Solicitor will take at least £1000 off you plus vat and you will still have to pay the fine and get points. Don’t draw attention to yourself, pay up and move on. RHA do offer sensible advice but from what you have told us, driver is guilty, unsafe load.

That's the problem straps on steel always use chains unfortunately don't think you have a case to put forward

Pay the £100 and take the points. This ain't a hill worth dying on mate. If it's the most unfair thing that happens to you during your time in haulage, you'll have got off lightly.

sorry but i think the load is your responsibility, if you were not happy you shouldn't of taken it and as others said chains not straps. Put it down to experience.

Take the points pay the fine and move on. Your pissing in the wind trying to appeal/fight that.
You were in charge of the load you restrained the load it’s 100 percent your responsibility. Although you feel you did all what you could to secure the load ultimately you didn’t as it fell off. If it were the case and you did all you could and it wasn’t secure you should have rejected the load.
Take it on the chin mate and put it down to a learning experience.

Pay the fine, take the points and get yourself on a good safe loading/load security course.
Put it down to experience but get the correct training as next time you may not be as lucky. 🙈

I know it's sh*te but soon as you took it was your baby. You will probably find that it what is classed as an Absolute offence crap but there you go.

Your the driver your responsibility its that simple if their was something wrong with it before you set off you should have refused to take it once you are on the road its down to the driver? You f**ked up take the points and fine

Hold on just a minute guys. Re-read the story. This guy looked at the load, and used 8 straps to secure it. It was the load that collapsed. Not sure what it was exactly that he loaded, but it sounds like a single piece of factory equipment. This driver secured the load, perhaps even over secured it, BUT, it seems to me like the article loaded actually broke. That is definitely not the drivers responsibility. That comes down to the owner of the article at the point of loading.

unfortunately you are correct, the driver can mitigate but ultimately he is responsible

Absolutely impossible for anyone of us to comment without seeing the the load before and after it was loaded and again once it collapsed we don't even know what said load was 🤷🏼‍♂️

In Germany it's not only the drivers responsibility, but the operator's, &, the loaders... All three would be fined.. Doesn't help your cause much, but a bit of useless information nevertheless..

that is a much better system, in the loading of a vehicle, there is more than just the driver involved. German's always do their sh*t well.

You got fined for an insecure load? but the load fell off the trailer into the road ?
The fact that it ends up in the road, by definition, that is an insecure load !!!

Your load your responsibility your the driver your responsible. You was happy to pull out with the load so yes just take the fine and points. You will not win against the police.

Google it m8. Read reviews and then the solicitors will tell you if he thinks you can get off with it if not then its still only 3 points all ya lose is consultation fee 👍

Solicitor alone will cost more than £100 and if you lose the case you may have a bigger fine from the courts and a solicitor still to pay. Think I would take the points and the £100 fine.

you can plead not guilty and represent yourself, give your version of events I was charged with reckless driving a judge through it out without even going to a hearing because sometimes it's obvious the police haven't got a clue and they lie, I wanted a trial because I had proof the police had lied.

We don't know the facts what if the load actually fell to bits (bolts worked loose or rivets didn't hold) the driver is not an engineer something mechanical could have failed inside the load, causing it to collapse, if you think it's unfair take it to appeal, be aware it can go against you the police know drivers are easy targets and like all the previous comments, they pay without question, go for drive, and good luck.

Be thankful it was the police that got involved, if the dvsa had turned up you would be standing in front of the traffic commissioner and they don’t use lube

Did you take pictures before you strapped it down after you secure the load an after the incident? Did the office or the guy you collect it from offer you any advice on how to secure the load?

If you had been I a union they would have provided you with what you require. Not helpful I know but a good warning for others.
