That's not true, the tacho records the whole calendar minute as what the longest continuous activity in that minute was. There are no seconds, the analysis just uses that tacho data to see if theres any infringements, but again it only seems whole minutes.

yes but if you start your break at 12.00 and 29 seconds and stop your break at 12.45 and second. The tacho will say it’s 45 minutes, but the analysis software will say it’s 44 minutes and 32 seconds. Ie an infringement.
This is why so many comments are saying take 46 or 47. This is a known issue and it’s to do with how the tacho records activities.
Best to have a company wide 47 minimum to account for the first and last whole minute. Same goes for the 15 and 30 and make it 17 and 32. That way you won’t have any issues. A couple of minutes is a couple of minutes and won’t make that much of a difference to the journey anyways. What usually does this is for example you stop at 12:00 and end the break at 12:45 but actually it’s 12:00:53 and then 12:45:50. That by all technicality is breaching your 45 minute break. Always add a minute to the start and finish and your well in the clear of any breaches. Your driver is probably right that he did take a 45 but didn’t account for the exact second which is what seems like has happened here.
I am coach driver same thing happened to me…I was waiting for rest almost 45mins but when it reach 45mins on time I started driving guess what it recorded only 15mins rest… this has happened to me not a story..

I know that but I’ve heard it being “advised” at meetings and cpc classes etc. If it puts folks minds at ease then fair enough.
