After a bit of advice, newish to hgv driving and only just started using my tacho (recovery driver from passing test). The other due I used my tacho Monday Tuesday, not Wednesday (passenger) then on Thursday but Thursday night I was in a bit of a rush and forgot my card. I deliver for Jewson so barely go near 4 1/2 hours driving anyway, this will show as other work but should I expect a fine or will they give me a chance to explain my error? TIA

If you’ve gone over your time you’ll just get an infringement, if you get pulled by vosa within 28days there’s the possibility of a fine, no fine if not

do 2 printouts, 1 for you & 1 for the office. put the reason on the back of the print outs, give the office theirs & keep yours for 28 days.

That is a big no no. Sadly you have truly f...ed yourself driving without a tachocard Jewson will probably boot you. If you had posted sooner i would have told you to say lost your card and got a new one. Now the truck has un accounted mileage the tm is going to do his nut. Should have gone home in car and got your card. Never mind new jobs are easy to come by. Just don't make the same mistake again

He hasn't driven without his card.....he left it in overnight and it was on other work.

You should have done 4 print outs on Friday.
2 in the morning, one for you and one for office explaining that the wrong mode was selected at end of shift Thursday and rest was taken. Then 2 more print outs at the end of shift Friday with the same explanation, one for office one for you.

Also if you have a hgv license and tacho card your card should be in slot 2 when you're a passenger

Did you drive without your card? Or did you leave your card in overnight?

Next time you forget your card do a manual print out use back of tacho paper not a problem.

Its Wednesday today so this was last week so you've driven since tachograph must have been screaming unless it defaults to rest when ignition off

If its just other work for a whole night dvsa will understand if you get pulled as long as you don't keep repeating the mistake same with your tm. If you get pulled by dvsa or police admit to it when they ask is there anything you would like to admit before we download your tachograph

and, if he has a diary, record it in that accordingly, detailing the discrepancies. Far easier to refer back to a written account than recall from memory and will seem far more professional.

My concern for you being a newbie, when so say a passenger what where you doing?.
You should really put a card in too even tho it's not being used up as such why?. If you got pulled by VOSA they would be in there right too do you for double Manning rules.
Illegal Example
You begin your shift passenger on the bunk with someone who does 13hour shift and then on end of that shift you enter your card and eject there's and continue the trip.
Or
Too gain a 24hour rest period within a working week and then take over etc etc

You should be more concerned with making sure in future you use your card even when a passenger just bang it in slot two put on other work switch to break same times as the driver does then your covered for that whole shift otherwise you either have to do a manual entry before start of next shift or explain it to dvsa should you get stopped . And for the leaving card in bit as others have said two printouts at start and end of shift and explanation in back one copy for you one for your TM

The day you was a passenger the card should have been in the second slot
