Today I was parked on an industrial estate for over 3hrs on bed awaiting instructions for my next job. Is it still classed as a split daily rest as I never did start / end country on the rest as I didn't expect being there that long? Even though I was on-call I was freely able to dispose of my time even though I didn't leave the cab.

Not being a c**k about it, it's just something I've never come across before. My main question was really regarding not using start/end country.

I think there's a difference in " sorry drive, your load ain't ready, well put you on a bay when it is" and "sorry drive, its gonna be at least 3 hours" Maybe that's more of an opinion than anything else though.

It’s as simple as “Hello drive my name is officer Freeburn from the DVSA. This period of 3+ hours you have recorded as bed - were you free to dispose of your time as you wish?”

I'd say, strictly speaking it can't be counted as rest. He awaiting instruction so still under obligation of his employer.
that doesn’t stop it being a Rest period. The rest period could end after 10m if he then had to work
what if he's not entirely sure what being able to freely dispose of his time means lol. He may have stated he was when he wasn't.
you could go on and say a daily rest isn’t a rest
As under obligation from the employer you must park at such and such truckstop

Personally the post I would say split daily
The driver has chosen to stay in cab go to bed etc
Could say the same when my drivers do it on a ferry mid shift from Portsmouth
I instruct them
They must be on that ferry they have a cabin available and legally a split daily aswell

It is perfectly possible to be expecting a call but still freely disposing of your time as you wish

that’s an easy answer - no he’s not working when he answers the call. He’s choosing to answer it. He must be because he’s free to dispose of his time as he wishes

If the caller then said “stand on one leg NOW!” And that caller was the employer then at the point he did that he is under instruction and obligation. The Rest finished.

To answer the OP. In my opinion as long as you were indeed free to dispose of your time as you wish then yes it was Rest
It would have been better to record end Country etc but here in the UK won’t cause a problem if you didn’t

I would however question whether you really were free to dispose of your time in the same way Leemo and Daveaxio have but if you say you were - we weren’t there.
Your tachograph will count it as a Split Rest no matter what you do anyway. It’s not clever enough to know otherwise.

But it’s 2023 now. There’s lots of old rules that have been amended. We have to abide by them now, not the ones from decades ago.

those were the old rules. If you had 4 hrs rest during the day, you could do a 16hr shift. The 4hrs didn't have to be continuous, each rest had to be at least 1 hr
