Hi all. I'm new to the forum. I'm looking for some advise if possible. I recently ended my employment with a company which was unfair dismissal and the now trying to cut my hours making up bullsh** saying I've been fiddling my hours 🤬 I've asked them for a full printout from my tacho we're there claiming I fiddled my hours but there refusing to give it me. Are they legally required to give me a printout if I request 1 and if not who would I contact so that I can get a printout because I don't want to be getting screwed over and having money taken off me. Any help would be appreciated. Thank you

Start an unfair dismissal claim, I'm currently doing one with one of my employers, I literally can't lose

Just find another driver to let you use his tacho to download a printout from your card

English employment law gives you absolutely no workplace rights and no access to tribunal if you haven't completed 2 years service..
Basically it'll cost you to fight them, and you'll probably lose.

I should say that if you have done 2 years or more you are protected against unfair dismissal.

This is totally correct! And they do legal have to give you all documentation including print off tacho! You would need to give them 7 days notice for request of evidence or documentation!

You said it'll cost him to fight them and he will probably lose, in reality it's a £35 small claims court fee (for claims up to £300) and he'd probably win if he's in the right as they won't bother fighting it. You said he had no rights and that's untrue.

he may not be able to fight unfair dismissal but he can fight unpaid salary through ACAS.

there are some circumstances where it doesn’t have to be 2 years…such as if his dismissal was down to discrimination, as a breach of contract, for raising H&S concerns or as a result of disability etc…there’s a few more such as pregnancy but I think he’s ok with that one 😂

This is very true, although without the tribunal it can be costly, and most companies will have lots of evidence to support their claims of denial.

Put your card in any tacho request a printout and choose date. Along as still on card will print it for you. I think they keep 28 days worth of details if I'm correct.

there are no time limits on the card
They are limited by the number of mode changes so if you are on multidrop local work your card won't hold as many days as a tramper on long haul

Print out driver 1 activities and it will give you a 7 day print out. Do that as many times as you can and you'll have all the data on your card.
You need to select the date each time and it will print 7 days back from that date

Go and see an employment solicitor they'll advise you best, I won my unfair dismissal case when I was sacked, I asked for journey sheets for specific dates over a period of time and they had all gone missing, once a solicitor gets involved they'll soon shit themselves

Order tachomaster and get a download box and do it yourself, when u contact tachomaster tell them what date u want the download to start from, the last time I used them it was a £1 a week

If you've started with a new company ask the coordinance person if they can do a print out for how ever many days or weeks you need

I keep a diary , start finish times and distances along with working time and places visited and of course printout with reasons for infringements …. There’s no arguing with it , helps if you get pulled with dvsa too

Usually they’ll scan it but know your running legit

DVSA don't want to see your diary because it doesn't mean anything to them, everything has to be recorded on your card nowadays.

DVSA don't want to see your diary because it doesn't mean anything to them, everything has to be recorded on your card nowadays.
correct, but if you whip out a diary showing everything you've done for the past year, they are more likely to give you a break👌

she was 1 horrible woman lol years ago I was down bogna Regus and my missis went into labour so I told her I was setting off back and she tried making me down a collection and delivery on my way back and I refused and she sacked me 🤣 mark just thinks of the £notes and all his drivers are just numbers 🤬

ACAS all day....I had a company a few years back not paying me holiday pay I was owed..spoke to the boss spoke to payroll nobody could help me in hindsight because the boss told them so gave up..... about 4 months later was out for dinner with my girlfriends mates..one worked In HR ...said call ACAS...so I did...I was told it was illegal to with hold payments and if they don't pay it can be heard at a tribunal..they contacted my old company and 2 day's later the money was in my account .. . companies will try it till they think they'll get in trouble.

You can check your hours on the rha website mate all tacho information is on there . You'll have to get a https://www.gov.uk/ pass code first though . Speak to acas they'll be able to help but I believe if you put your request in writing to them they have to honour it .

Speak with acas 100%. If they’re accusing you of something they need to show proof to support the accusation. If you haven’t done anything wrong then I wouldn’t stress about it. Just let them handle it. Good luck👍🏼
