Transport manager employment contract / agreement template (external TM) – HGV & PSV versions

Post by Admin »

The contract template below has been accepted by the Traffic Commissioner's Office thousands of times (see at the bottom half of this page for details about that). Is is a neutral and fair to both sides contract. I strongly recommend both transport managers and operators to use this template. If you are asked to sign a different or modified contract, make sure to read and understand what you are signing to avoid issues like with Cunning Ian Cunningham.

Below are older versions of these contracts – do not use those, use the ones above instead. I left them here to preserve the history. They had to be amended because after many years of using them thousands of times, around November 2024 the caseworkers and the traffic commissioners, all of a sudden started freaking out big time about the fact that the contracts do not explicitly state how many hours the TM will work and how much the TM will be paid. As common in many legal documents, the contracts referred to the relevant TM1 form for work hours and to the invoices where the amounts may vary from month to month and can be negotiated on a task-by-task basis (as often done in practice) but they wanted explicit figures hardcoded into the contract and they made a big fuss out of it. They even revoked a licence on 17/12/2024 for half a day because of it but then reinstated it later on the same day, likely realising the absurdity of their actions or their mistake but they never admitted it. They simply stated "we reinstated your licence but it is for you to satisfy the traffic commissioner". See the screenshots below.
