Full rest as 11 hours since last duty and 26 hours since last one started.

9 hrs as his/her day started at 06:00 and within a 24 hr period he/she has only accrued 9 hrs continuous rest. The 08:00 start for the next day is the new start time for his /her next 24 hr period.

By law 9 hours rest in a 24 hours day ( reduced break ) 🤔😁!?!?!!!!!!!!!!! D:))))

My personal opinion is that 15 hour days should be scrapped altogether.
12 hours should be the maximum. In no other industry is a 15 hour day the norm.

I see quite a few companies going towards 13hr standard and 15 as a drivers choice now

Depends on what you are asking. He’s been on rest for 11hrs if we just count hrs spent on rest. But legally it’s still a reduced (9hr) if he worked for 15hrs 🤷‍♂️ good luck with explaining it to some drivers though.

He’s had a reduced daily rest of 9 hrs as the 8.00 start next morning is irrelevant, it’s the 24 hr period 06.00-06.00 that counts

9 hrs under 24 hr rule. Irrespective of physical rest period actually taken

Forget 9s and 15s etc.
Its a reduced daily rest because his shift exceeded 13 hrs. Thats all their is to know.

well there is more to it if he done a split rest then its a full 12hrs rest 🙂

fair enough, if a split daily rest after a 15 hour shift, the 9 hour rest doesn't count as one of the three reductions (below 11 hours) permitted during a working week.

yep split daily rest is counted as a regular rest so no issue. Wouldn’t do that 5 days a week or recommend it to anyone but as far as regulation goes its legal.

container work, spending many hours resting whilst the box is tipped by hand, is the perfect type of driving work lending itself well to split daily rest (near enough 15 hour spread) on every shift of the working week.

as long as they allowed to leave company premisses it can be can be classed as a rest. But you are right often this rule is misused to get more work done.

nfortunately, in the eyes of the law when taking daily rest according to the split rules, they are legally on rest.
I agree with what you state however, as on occasion I am sure that there are drivers who "tip / work on break" (during the 3 hour rest / break period).

I pointed out that I knew that and questioned why you might think I didn't by asking "where did I state you couldn't ? (have a reduced daily rest every day).

unfortunately in the eye's of the law if not able to freely dispose of their time as they see fit then not on rest legally.

Depends what driver did throughout the day. It’s possible to have a 3 hour rest mid shift then it would count as a full daily rest

9 - once you go over 13 hours it is a reduced - unless has had a split rest

He's had 11 hours off but still counts as a reduced daily rest of 9 hours in the 24 hour period.

Every shift over 13h is considered as reduced daily rest my friend (y)

Unless it's split rest of course.

The 24 hour period starts when the driver puts his card in. In this case tacho wise is 9 hour rest, with an 0800 start the next day giving him the option to stay in bed a couple of extra hours…
Make him start at 0600 and clean the wagon for 2 hours! Lol 😂

9 hours rest. Daily rest must be completed within 24 hours of duty starting. Regardless of what time his next duty starts he has only had 9 hours rest within this 24 hour period.

11 hours unless he’s taken a rest in a split shift of at least 3 hours. In which case he didn’t need to take 11 hours rest.

9 hours reduced rest as the rest has to be taken in the 24 hour duty period, so they started at 06.00 therefore that duty period end at 06.00 the next day , 06.00 to 08.00 is non working time

Why complicate matters, there are 3 hours left in days 1, add on the hours in day 2 before start of next shift ,i.e. 8 hours, so 3 plus 8 =11....simples

9 hours daily rest, as it has to be calculated in the 24 hour period that commenced at 0600.
Driver has used up one of their three permitted daily rest reductions (below 11 hours) during their WORKING WEEK (not fixed week).
