Get you nominated TM to do as asked and all will be fine.
Most of us have had to do it, at one time or another.
I now include such a letter with any initial application and never been asked for anything else, once submitted.

I've done 2 fixed term contracts as ETM. Where I was there until their own guy gained their certification. Once they were added to the licence, I'd do 1 month alongside them and then take my name off. Never been asked why, nor sent any explanation.

It's still taking a space on the TM allowance. So gets charged accordingly. Would you charge less to deliver 10 kilos of Lead, over 10 kilos of feathers. Because it takes less room? well... it's also about affordability.. I am clearly not making the same amount of money as a lorry owner driver 🤷🏻♂...

in 18 years there has never been a prosecution, so basically it's a totally unenforced law. it maybe unenforced. I may be wrong but i don't believe anyone, in any Industry, has been prosecuted for breach of WTD. It's not law, just guideline as I understand it. Yes. I am sure that you must. One of my clients is having none of that and insist that you don't have to. Am sure if TC finds out you would have to answer some questions. You've investigated. They've denied it. They have also signed a declaration denying it.
I'd say you've covered your back and done all you can.
Maybe a Toolbox Talk about driver fatigue, including a mention about 2nd jobs. Get them to sign that off as well.

Or 7 without the tractor 9 as the vans need to be included as towing trailers yeah I put 9 first but then read that if the tractors were used for haulage they don’t require an o license it says 'tractor units'. Scania R450 etc. Not 'tractor' as in David Brown, Case etc. It's all in the wording.
