Looking for advice please.
I’ve been flagged up with two infringements by Tachomaster.
I only drove twice 9.30h in same M to Sunday week and between weekly rests, and less than 40 hours all together.
I only reduced my daily rest three times to 9 hours in the same period.
I just don’t understand what happened.
TIA

How many times did you exceed 13hrs duty
Also if your employer is giving you these reports they should be telling you what the problem is

I'm sorry but without a lot more information nobody can tell you what the problem was
Your employer is failing in their responsibilities if they don't explain so that you can avoid further issues

ok I worked 4 days over 13 hours but only took 3 daily rest under 11 hours

ok I worked 4 days over 13 hours but only took 3 daily rest under 11 hours
but if you went over 13hrs then it's a reduced rest no matter how many hours you have off
You duty and rest must fit within 24hrs from start of shift so once you go over 13hrs you can no longer fit 11hrs rest in

I understand… And exceed of driving time infringement is related to that?

How many days have you driven over 9hrs in the last 2 fixed weeks and which days

I starred this job on Wed 6th
I took 36h rest on Tues 12th
I drove 9:30h on Wed 13th and Fri 15th
possibly drove the 4h41m before taking break to reset
no the infringement was for daily total mate
strange as only 4h41 total
I think it might be that he had a 4th reduced daily rest and the tacho has counted as one shift and aggregated 2 days driving as 1 day but I'm not really 100% on that

ah yeah good thinking the sat and Sunday combined in one
can't see anything wrong there
Am I missing something Leeshop
start 10:45
Worked 10hours
Drove 3:29 hours…
if you do not take sufficient rest (like reduce when you have already done so 3 times) then the two days driving can be added together. Perhaps this explains the double infringement

that’s exactly right. If you don’t take sufficient daily rest the 2 days drive totals are added forcing drive time infringements
And on the drive time did you not go over a 9 by 1 minute in that working week period by accident
If so that could be the problem or there’s a fault in the checking system

no, I was well short of 9 hours, only twice went 9:30h

my guess is either the night worker or GB Domestic setting incorrectly set up by the company. It's buried in one of the sub menus in Tachomaster but I can't remember exactly where!
I just realised
And driving times? I only drove over 9 hours twice
the only thing I can think drive time is did you have a break on 17th
Or did you drive 4:41 without a full break?
his infringement is for daily drive time
ah correct
So it would appear that as he has had a 4th reduced daily rest off that Saturdays drive time has rolled on and continued in Sunday due to the insufficient Dailey rest (tacho assumes he’s carried on shift from Saturday through Sunday as 1 shift)

When does your working day usually start and finish? (Bright sunshine and small screen - apologies if you've already posted it)
keeps changing… I start between 11:00 and 15:00, usually long shifts
4 shifts over 13 hours means the last one flags up as not enough daily rest and bumps the Saturday and Sundays driven hours together which give you the drive time exceeded.

Always have 11hrs of between shifts
Works for me
just because you have 11 hours rest doesn’t mean that it’s not a reduced rest…don’t forget the 24 hour rule
true
But I always do 9 hr drives and save a 10 for Friday
Plus 45hrs off at weekends
13 hours duty + 11 hours rest = standard rest…13 hours 1 min + 11 hours rest = reduced rest.
You need to be able to fit your 11 hours rest into the same 24 hour period as your duty.

Matters not what time you start, you should know when you can legally start your next shift and how many hours you can drive or work in any 24hr period ... If you have trouble keeping a track of what hours you have done then download an app such as TachoGuard (or similar) on your phone and simply click on the symbols the same as you do on the tacho and it will tell you exactly how many hours driving uoi have done, how many reduced daily rests you've taken or extended driving hours etc and how many you have left etc and it keeps a log for you. It beats writing everything done and doing the calculations yourself.
